These Terms of Service ("Terms") govern your access to and use of the CallCrew website, dashboard, AI answering service, and contractor overflow network (collectively, the "Service") operated by CallCrew ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Service Description
CallCrew provides an AI-powered phone answering service designed for contractors in all trades. Our Service includes:
- AI Call Answering — an AI assistant answers inbound calls to your dedicated business phone number, captures caller details, and notifies you of new leads.
- Contractor Overflow Network — when you are unavailable or at capacity, jobs may be routed to other qualified contractors in our network (and vice versa). You receive overflow leads from other contractors in your trade and service area.
- Dashboard — a web-based dashboard where you can view call logs, manage your profile, and track overflow job referrals.
2. Account Terms
- You must be at least 18 years old and able to form a binding contract to use the Service.
- You must provide accurate, complete, and current information during registration and keep it up to date.
- You are responsible for maintaining the security of your account credentials. We are not liable for any loss arising from unauthorized access to your account.
- One person or business entity may not maintain more than one free trial account.
3. Billing & Payments
3.1 Subscription
The Service is offered on a monthly subscription basis at $99 per month. Your subscription automatically renews each billing cycle unless cancelled before the renewal date.
3.2 Free Trial
New subscribers receive a free trial period (as advertised at the time of signup, typically one month). No credit card is required to start the trial. At the end of the trial you must add a payment method to continue using the Service.
3.3 Overflow Commissions
When you receive a job through the CallCrew overflow network, a commission is applied to the referred job:
- 10% commission on jobs received through the overflow network (standard rate).
- 15% commission on jobs received through the overflow network where CallCrew facilitated payment collection or additional coordination.
Commission rates are subject to change with 30 days' written notice.
3.4 Refunds
Subscription fees are non-refundable once charged. If you cancel mid-cycle, you retain access to the Service through the end of your current billing period.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or to solicit others to perform unlawful acts.
- Misrepresent your trade qualifications, licenses, or insurance coverage.
- Interfere with or disrupt the Service or servers connected to the Service.
- Attempt to gain unauthorized access to other users' accounts or data.
- Use the Service to send spam, unsolicited communications, or automated calls unrelated to legitimate business inquiries.
- Reverse-engineer, decompile, or otherwise attempt to extract the source code of our AI models or proprietary software.
5. Intellectual Property
The Service, including its AI models, software, branding, and content, is owned by CallCrew and protected by intellectual property laws. You retain ownership of your business data and content you provide. By using the Service, you grant us a limited license to use your data as necessary to operate and improve the Service.
6. Limitation of Liability
To the maximum extent permitted by applicable law, CallCrew and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
The AI answering service is provided "as is." While we strive for accuracy, we do not guarantee that the AI assistant will capture every detail of every call without error. You acknowledge that AI-generated responses may occasionally be inaccurate or incomplete.
7. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
8. Termination
You may cancel your subscription at any time through your dashboard or by contacting support. We may suspend or terminate your account at any time if you violate these Terms, with or without notice. Upon termination:
- Your access to the dashboard and AI answering service will be revoked at the end of your current billing period (or immediately in the case of a Terms violation).
- Your dedicated phone number may be released and reassigned.
- Outstanding overflow commissions remain payable.
- We will retain your data in accordance with our Privacy Policy.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Duval County, Florida.
10. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or a prominent notice on the Service. Continued use of the Service after the effective date of revised Terms constitutes acceptance.
