These Terms of Service ("Terms") govern your access to and use of the CallCrew website, mobile app, dashboard, AI answering service, and contractor overflow network (collectively, the "Service"). CallCrew is a service of Gutta Holdings LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Service Description
CallCrew provides an AI-powered phone answering service designed for contractors in all trades. Our Service includes:
- AI Call Answering — an AI assistant answers inbound calls to your dedicated business phone number, captures caller details, and notifies you of new leads. All calls are recorded and callers are notified at the start of each call. By using the Service, you authorize CallCrew to record calls on your behalf.
- Contractor Overflow Network — when you are unavailable or at capacity, jobs may be routed to other qualified contractors in our network (and vice versa). You receive overflow leads from other contractors in your trade and service area.
- Dashboard & Mobile App — a web dashboard and mobile app where you can view call logs, manage your profile, accept overflow jobs, and track referrals.
2. Account Terms
- You must be at least 18 years old and able to form a binding contract to use the Service.
- You must provide accurate, complete, and current information during registration and keep it up to date.
- You are responsible for maintaining the security of your account credentials. We are not liable for any loss arising from unauthorized access to your account.
- One person or business entity may not maintain more than one free trial account.
3. Billing & Payments
3.1 Subscription
The Service is offered on a monthly subscription basis at $99 per month. Your subscription automatically renews each billing cycle unless cancelled before the renewal date.
3.2 Free Trial
New subscribers receive a free trial period (as advertised at the time of signup, typically one month). No credit card is required to start the trial. At the end of the trial you must add a payment method to continue using the Service.
3.3 Overflow Commissions
The CallCrew overflow network uses the following commission structure:
- Referral fee (10%) — when you send a job to the network that another contractor completes, you earn a 10% referral fee.
- Network fee (15%) — when you receive and complete an overflow job from the network, a 15% network fee applies (you keep 85% of the job value).
Commission rates are subject to change with 30 days' written notice.
3.4 Refunds
Subscription fees are non-refundable once charged. If you cancel mid-cycle, you retain access to the Service through the end of your current billing period.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or to solicit others to perform unlawful acts.
- Misrepresent your trade qualifications, licenses, or insurance coverage.
- Interfere with or disrupt the Service or servers connected to the Service.
- Attempt to gain unauthorized access to other users' accounts or data.
- Use the Service to send spam, unsolicited communications, or automated calls unrelated to legitimate business inquiries.
- Reverse-engineer, decompile, or otherwise attempt to extract the source code of our AI models or proprietary software.
5. Intellectual Property
The Service, including its AI models, software, branding, and content, is owned by CallCrew and protected by intellectual property laws. You retain ownership of your business data and content you provide. By using the Service, you grant us a limited license to use your data as necessary to operate and improve the Service.
6. Limitation of Liability
To the maximum extent permitted by applicable law, CallCrew and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
The AI answering service is provided "as is." While we strive for accuracy, we do not guarantee that the AI assistant will capture every detail of every call without error. You acknowledge that AI-generated responses may occasionally be inaccurate or incomplete. CallCrew is not liable for missed calls, dropped calls, incorrect information provided to callers by the AI assistant, lost leads, or any business losses resulting from AI errors or service interruptions. You are responsible for verifying the accuracy of information captured by the AI before acting on it.
7. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
8. Indemnification
You agree to indemnify, defend, and hold harmless CallCrew and its officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to:
- Your use of the Service or violation of these Terms.
- The quality, safety, or legality of any work you perform on jobs obtained through the overflow network.
- Any dispute between you and a customer or another contractor in the network.
- Your failure to maintain required licenses, insurance, or permits for your trade.
CallCrew is a technology platform that connects contractors. We do not supervise, direct, or control the work performed by contractors and are not responsible for the quality or outcome of any job.
9. Termination
You may cancel your subscription at any time through your dashboard or by contacting support. We may suspend or terminate your account at any time if you violate these Terms, with or without notice. Upon termination:
- Your access to the dashboard and AI answering service will be revoked at the end of your current billing period (or immediately in the case of a Terms violation).
- Your dedicated phone number may be released and reassigned.
- Outstanding overflow commissions remain payable.
- We will retain your data in accordance with our Privacy Policy.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be resolved through good-faith informal negotiation. If the dispute cannot be resolved within 30 days, either party may initiate binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in Duval County, Florida. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
You agree that any arbitration or proceeding shall be conducted on an individual basis and not as a class action, class arbitration, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against CallCrew.
11. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or a prominent notice on the Service. Continued use of the Service after the effective date of revised Terms constitutes acceptance.
